KARLSRUHE / BERLIN (dpa-AFX) – After the decision of the Federal Constitutional Court on the so-called triage, the parliamentary groups want to take action quickly. Legal regulations should be passed quickly, announced the health policy spokeswoman for the SPD parliamentary group, Heike Baehrens, and the legal politician Johannes Fechner (SPD) on Tuesday. “The decisive criterion must be the current and short-term probability of survival.” A regulation in the General Equal Treatment Act is conceivable for this. “We will start consultations on this in January.”

The Karlsruhe court had ruled with reference to the Convention on the Rights of Persons with Disabilities that the Bundestag must “immediately” take precautions to protect people with disabilities in the event of triage – that is, when doctors have to decide who to save and who not to save in the face of scarce resources. When it comes to implementation, the legislature has leeway. (Az. 1 BvR 1541/20)

FDP Vice President and Bundestag Vice President Wolfgang Kubicki also welcomed the decision. “The decision of the Federal Constitutional Court is legally comprehensible, since after the value decision of our Basic Law, questions of life and death must be decided by the legislature and not by private agreement,” he told the “Rheinische Post” (Wednesday). “The fact that the Union that appointed the Federal Minister of Health in the last legislative period did not act here for a year and a half unfortunately fits into the picture of a corona policy under Chancellor Merkel that is only designed for short-term.”
